    I can understand why a game company would want to fight against releasing roms for newer game systems for free download, but what about the old systems? They only way you can purchase old games now is used, and even then they aren't making a penny. What would the difference be if we just downloaded them?

    Because they own the rights to the games.
    It's not just the fact of making money.
    Look at x360's arcade, or Wii's virtual console.
    You have to pay to play the old games.
    They keep the rights so they can do stuff like that.

    Ahhaa, I hate this subject.

    Its complex and the bits I understand are.

    Nintendo = No go on any roms, Seen the Wii? obvious why.

    Arcade = Roms are legal to download and own but they are for the purpose of reparing the roms in the arcade machine you own. If you use them for other purposes (e.g. MAME) then they are illegal

    Sega = Probably fall into the same boat as Nintendo now, but they do not police so heavily.

    Sony = pretty obvious really, how's your prison cell?

    Basically the company has to class it as abandoned/abandonware/free/whatever. Usually if you contact the license holder they will tell you definitively either way, if the license holder no longer exists than the original programmer can sometimes suffice. This is why you can get a lot of PC and Amiga games (plus other formats) legally downloaded from the net for free (but in the case of the amiga the kickstart rom is illegal as its still sold) so you can't play the games legally without those files.

    Its very complex and this is a really basic description/breakdown of how it all works out.

    1. Because they're free.
    2. Because I can play them anywhere I want on my psp.
    3. Because I don't own the systems.
    4. I don't feel like buying the systems.
    5. I don't need the systems cluttering my home entertainment system.

    In which case they wouldn't be offering them to buy on their service.

    And if its their Patent it just means people can copy the ideas and designs, they still legally own the rights to the roms still making it illegal to download them

    Just try and make a direct mario clone I'm sure they will do you for intellectual copyright thefts if you tried to sell it for money.
