    Default Legal issues of CFW

    Are there any legal issues with having CFW on your PSP? Like if I went to Sony's headquarters with a modded PSP could I get sued? Is it illegal for me to have a website where I offer to downgrade or upgrade PSP's to which ever firmware the customer desires?

    I have a disclaimer page that states this:
    Organized_Chaos is in no way responsible for any illegal actions or crimes committed by the end user with modded PSP's. Organized_Chaos only mods the firmware of the PSP to play homebrew applications made free to the public or to play games backed up in ISO, ROM, or PBP formats created by the end user. Furthermore, the end user agrees that he or she will not use the PSP to break laws in anyway.

    This means don't do things illegally. Don't pirate games, music, or videos! It will ruin the PSP scene because companies will no longer produce stuff for the PSP if they don't make money from it.
    Would this cover my ass if someone got caught doing something illegal with their PSP and then tried to blame it on me for modding it? Is there anything I should add to that? After I read over it I've decided I need to reword it. Any tips on how I should reword that disclaimer?

    I don't understand what that has to do with this question.

    According to what Jibbz posted everything on this website is illegal. This website exists to assist people with modding their PSP's which will allow people to play pirated games. Why haven't the admins and moderators been busted and tossed in jail for this yet? And yet even though in my disclaimer I tell people I am not doing this to allow the pirating of games it is still illegal?

    Last time I checked, the user agreement in the FW updates specifically tells you that messing with the firmware, modifying it, is strictly prohibited.

    Having a modded PSP means nothing since you might not have messed with the firmware. No evidence really, unless they go through your PC, or find the update on the MS.

    Having ISO's though is legal to a point.
    1. You must own the original copy.
    2. That ISO must be the only digital back up you own of that software/game.
    3. You are the person who made that ISO from your hard copy/other software.

    Hm.... this is bogus.

    I feel like if it applies to consoles, why not everything else?

    -I put third-party pickups in my guitar... am I going to jail? No.
    -I put a different engine in my car... am I going to jail? No.
    -I put third-party software in my PSP... am I going to jail? If I get caught, I suppose.

    Your car & guitar don't have a copyright law on them....

    And you won't go to jail if the Sony police catch you.

    the difference is that ur basically renting the software from sony and when u modify there software(even thou u didint make it but just installed it) ur, in essence, stealing there code. now you can take apart ur psp and add all the led's u want and play with the hardware all you want.

    I'm willing to bet, he was modding the firmware in the Xbox 360 to play "backed-up" games.
