Default Is it illegal to host OFW?

Is it illegal to host OFW on a website if the person hosting it doesn't edit the file? Sony provides this to us for free with the only warnings being the generic "Don't modify this file or reverse engineer it" kind of thing.

i would definitely say no for OFW. CFW i would think is kinda iffy.

OFW is distributed by sony free of charge and is actualyl encouraged to be distributed (cuz sony wants everyone up to date and not hackable =P)

CFW is iffy, yes, because Although its not illegal for the end user to modify their firmware, it is illegal to distribute the source code, which therefore could be a infringement.

Ultimately, if PSP-Hacks.com is hosting it, I'd have very little worry about its legality issues and I'd host it on my site with no worries.

It is legal to host a packed OFW.

It is illegal to distribute individual files.

CFW is legal because it requires a packed OFW file, not individual files.
The OFW is taken apart on the PSP itself.

(Kinda like CyanogenMod can't have Google apps bundled with it, but they can be bundled separately for you Android guys).

It depends on where you live / server is located and the local laws there.

You should double check the license, if you're unsure. Ultimately, even if it's technically illegal to redistribute OFW, Sony don't appear to be litigating anyone over it, so I'd assume you're safe.
CFW license probably allows redistribution (would be silly otherwise), however, the other angle would be whether it would be considered a copyright infringement tool. I don't think such a thing has been challenged in court anywhere. However, Sony clearly aren't very interested in suing anyone over this anyway, so you're probably safe too.

Thank you for the responses. I was having a debate with a friend about this and I just wanted to make sure I was right (and I was).
